Medicaid administrators allude to an “employership liability” as a justification for their current effort to eliminate the Independent Caregivers. T he validity, or falsehood of such liability, hinges on whether the individual who signs a contract with the State to provide personal care services for a Medicaid participant, is actually functioning as a State employee or as an independent contractor.
So far, administrators are unable to validate their claim. It appears to be a misunderstanding and an exaggeration.
